Terms of Service

OVERVIEW
Welcome to North Bioko Club (“NBC”, “we”, “us” or “our”). We operate this website and store, including related content, features, products and services (the “Services”). Our online store is powered by Shopify, and we also sell through TikTok Shop.
These Terms of Service explain the conditions that apply when you use our Services or purchase our products. Please read them alongside our Return and Refund Policy, Shipping Policy and Privacy Policy, available on our website.
North Bioko Club is a UK-based sole trader business. Information identifying our legal operator and further contact details is available on our North Bioko Club - Contact Page.
Nothing in these Terms limits any consumer rights that cannot lawfully be excluded or restricted.
SECTION 1 — ACCESS AND ACCOUNTS
Our Services are intended for people aged 18 and over. By placing an order, you confirm that you are at least 18 and legally able to enter into a contract.
You must provide accurate and current information needed to process your order, including payment and delivery details. You must be authorised to use the payment method provided.
If you create an account, please keep your login details confidential and notify us promptly if you suspect unauthorised access. You must not sell or transfer your account to another person.
SECTION 2 — OUR PRODUCTS
NBC garments are limited-edition, hand-painted and/or hand-distressed pieces. Small variations in colour, pattern, paint placement, distressing and finish are part of their individual character.
Product images illustrate the item’s general appearance. Screen settings may also affect how colours appear.
Variations consistent with the product description and disclosed hand-finishing process are not, by themselves, defects. This does not affect your right to receive goods that are of satisfactory quality, fit for any purpose required by law and as described.
Please follow the care instructions supplied with your garment. Damage caused by failing to follow appropriate care instructions may not qualify as a product fault, but this does not affect your rights where the item was faulty or the instructions were inadequate.
We may update listings or discontinue products. Changes do not retrospectively alter the description or agreed terms of an accepted order.
SECTION 3 — PERSONAL USE AND PURCHASE LIMITS
Our products are sold for the personal use of the buyer or their intended recipient. Purchasing products for commercial resale requires our prior written permission.
To keep limited releases fairly available, we may apply purchase limits per order, account, payment method or customer. Applicable limits will be communicated before purchase.
We may decline orders where we reasonably believe a customer is attempting to evade those limits, purchase for unauthorised commercial resale or use automated purchasing tools.
Any action affecting an accepted order will be handled in accordance with Section 5 and your legal rights.
SECTION 4 — PLACING AND ACCEPTING ORDERS
When you place an order through our website, you make an offer to purchase the selected products.
An automated message acknowledging receipt of your order does not, by itself, constitute acceptance. A contract is formed when we expressly confirm acceptance or dispatch the products, whichever occurs first.
Payment may be authorised or collected before acceptance. If we do not accept your order, we will release the authorisation or refund any payment without undue delay.
Please check your order carefully before submitting it. If you need to make a change, contact us promptly. We may be unable to change an order once fulfilment has begun, but your statutory cancellation rights remain available where applicable.
Orders placed through TikTok Shop are also subject to the platform’s applicable checkout and order procedures. Nothing in these Terms reduces mandatory consumer rights or protections applicable to that purchase.
SECTION 5 — AVAILABILITY, ERRORS AND ORDER CANCELLATIONS
We take reasonable care to keep product information, prices and availability accurate. Occasionally, errors or stock discrepancies may occur.
Before accepting an order, we may decline it because of unavailable stock, an incorrect price, payment problems or a reasonable concern about fraud or a breach of purchase limits.
If we discover a material error, we will explain it and, where appropriate, offer you the choice of proceeding on corrected terms or cancelling for a full refund. We will not charge an increased price without your agreement.
Once an order has been accepted, we will not change or cancel it arbitrarily. If we cannot fulfil an accepted order, we will notify you promptly and refund any undelivered products and associated delivery charges as appropriate. A refund does not remove any additional remedy you may have under applicable law.
SECTION 6 — PRICES, PAYMENTS AND TAXES
The applicable price and currency will be shown before you place your order. Prices may change for future purchases, but changes do not affect accepted orders.
Consumer prices include VAT and other taxes that we are required to include by law, where applicable. Delivery charges and any additional charges collected by us will be disclosed before you complete your purchase.
International deliveries may attract customs duties, import taxes or carrier clearance charges that are not collected at checkout. Where these are payable by you, this will be explained before purchase and in our Shipping Policy. You will not be required to pay the same charge twice where it has already been collected.
Promotions may have additional conditions, including eligibility requirements and expiry dates. Those conditions will be provided with the promotion.
SECTION 7 — SHIPPING, DELIVERY AND RISK
Our delivery options, charges and estimated timeframes are explained at checkout and in our Shipping Policy. Our current courier is DPD.
Unless another delivery period is agreed, we will deliver orders without undue delay and within the period required by applicable law. For UK consumer orders, this is normally no later than 30 days after the contract is made.
If a significant delay occurs, we will notify you and explain the available options. Your legal rights concerning late or failed delivery remain unaffected.
For UK and EU consumers, products remain at our risk until they come into your physical possession or that of a person you have nominated to receive them, other than the carrier. Any statutory exception for a carrier independently commissioned by you will apply where relevant.
Courier tracking, photographs and collection records may help establish what happened to a delivery. They are not conclusive evidence that you received an order and do not override your consumer rights.
If an order is marked as delivered but has not arrived, please contact us so we can investigate with the courier.
Where collection from a depot or collection point is required, please follow the courier’s identification and collection instructions.
SECTION 8 — RETURNS, REFUNDS AND CANCELLATION RIGHTS
Our Return and Refund Policy explains the process for returns, exchanges and refunds, including our additional voluntary return conditions.
Eligible UK and EU consumers generally have 14 days after the day of receiving goods to notify us of a statutory cancellation, followed by a further 14 days to send the goods back. Legal exceptions may apply, including to goods made to your specifications or clearly personalised.
A garment is not excluded from cancellation rights simply because it is hand-painted, hand-distressed or limited-edition.
Our voluntary return windows, condition requirements and processing fees do not override statutory cancellation rights or rights relating to faulty, damaged or misdescribed goods.
SECTION 9 — INTELLECTUAL PROPERTY
The North Bioko Club name, logo, original artwork, designs, photographs, text and other website materials belong to us or our licensors and are protected by applicable intellectual property laws.
You may browse and use our Services for personal, non-commercial purposes. Except where permitted by law or expressly authorised, you must not reproduce, commercially exploit or use our protected materials or branding without permission.
Buying a garment transfers ownership of the physical item, but does not transfer copyright or other intellectual property rights in its artwork or design.
Shopify’s trademarks and other third-party trademarks belong to their respective owners.
SECTION 10 — FEEDBACK, REVIEWS AND CUSTOMER CONTENT
If you voluntarily send us non-confidential suggestions or ideas about our products or Services, we may use them to improve our business without paying compensation, unless we agree otherwise.
You retain ownership of photographs, videos, reviews and other content you create.
When you submit a review for publication on our website, you give us a non-exclusive, royalty-free licence to display that review in connection with the relevant product or our store. We may make minor formatting edits without changing its meaning.
Tagging us on social media does not automatically give us permission to reuse your content. Before reposting customer photographs or videos or using them in marketing, we will seek permission unless you have already granted it through a clear submission agreement. Any use will remain within the permission given, with credit where agreed or reasonably practical.
Only submit content that you own or have permission to share. It must not infringe another person’s intellectual property, privacy or other rights.
We may remove unlawful, abusive, fraudulent or irrelevant content. We will not remove a review merely because it expresses a genuine negative opinion.
SECTION 11 — THIRD-PARTY TOOLS AND LINKS
Our Services may include tools, integrations or links provided by third parties. Their own terms and privacy policies may apply when you use their services.
We do not control independent third-party websites or guarantee their content. However, this does not exclude our responsibility for our own obligations or for services we are legally responsible for providing.
SECTION 12 — RELATIONSHIP WITH SHOPIFY AND TIKTOK SHOP
Shopify provides the platform that powers our online store. Purchases made from North Bioko Club through that store are contracts with us, rather than Shopify.
When you purchase from us through TikTok Shop, TikTok provides the marketplace and related platform services. Applicable platform terms explain its role in payment processing, order management and customer protections.
Questions about NBC products or our fulfilment of your order can be directed to us. Platform-specific issues may also be handled through the relevant platform’s support process.
Nothing in these Terms excludes any responsibility that Shopify, TikTok or another provider has under applicable law.
SECTION 13 — PRIVACY
Our Privacy Policy explains how we collect, use and share personal information, including our use of Shopify, TikTok Shop, Mouseflow, Omnisend and Google, TikTok and Meta tracking technologies.
Using our website or accepting these Terms does not, by itself, constitute consent to optional tracking or marketing. Where consent is required, we obtain it separately through the relevant controls.
SECTION 14 — PROHIBITED USES AND AUTOMATED ACCESS
You must not use our Services to:
-
Commit fraud, impersonate another person or provide deliberately misleading information.
-
Infringe intellectual property, privacy or other legal rights.
-
Harass or threaten others or submit unlawful content.
-
Introduce malware, disrupt the website or bypass security measures.
-
Collect other people’s personal information without a lawful basis.
-
Send unsolicited promotional material through our Services.
-
Use purchasing bots or other methods to evade release restrictions or quantity limits.
-
Scrape or extract website content in breach of applicable law or our intellectual property rights.
Automated purchasing agents require our prior written permission. Any authorised agent must identify itself accurately, comply with access restrictions and stop when requested. Permission to use an agent does not permit bypassing security or purchase limits.
These restrictions are not intended to prevent ordinary use of accessibility tools.
SECTION 15 — SUSPENSION AND TERMINATION
We may restrict or suspend access where reasonably necessary to address fraud, security threats, unlawful conduct or a material breach of these Terms.
Where practical, we will explain the reason and allow an opportunity to resolve the issue. Immediate action may be necessary to protect the Services or other users.
Closing or suspending an account does not remove rights relating to existing purchases, refunds, complaints or personal information.
SECTION 16 — WEBSITE AVAILABILITY AND PRODUCT RIGHTS
We take reasonable care in operating our website but cannot promise uninterrupted or error-free access. Maintenance, technical issues or events outside our reasonable control may temporarily affect availability.
General website content is provided for information. This does not qualify or override product descriptions, pre-contract information or commitments forming part of your purchase.
We do not sell consumer products on an “as is” basis that excludes statutory quality standards. Your rights concerning satisfactory quality, fitness for purpose and conformity with description remain unaffected.
SECTION 17 — OUR LIABILITY
We are responsible for foreseeable loss or damage caused by our breach of these Terms or our failure to exercise reasonable care and skill. Loss or damage is foreseeable if it is an obvious consequence or was reasonably contemplated when the contract was made.
Our products and Services are supplied for personal use. We do not accept liability for business losses such as lost commercial profits, business interruption or lost business opportunities.
We do not exclude or limit liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation or any other liability that cannot lawfully be excluded or limited.
Nothing in these Terms removes your remedies for faulty, unsafe or misdescribed goods.
SECTION 18 — EVENTS OUTSIDE OUR REASONABLE CONTROL
If an event outside our reasonable control affects an order, we will notify you as soon as reasonably possible and take reasonable steps to minimise its impact.
Such an event does not automatically remove your right to cancel, receive a refund for undelivered goods or exercise other remedies available under applicable law.
SECTION 19 — TRANSFERRING RIGHTS AND OBLIGATIONS
We may transfer our rights and obligations to another business only where this does not reduce your contractual guarantees or consumer rights. We will notify you where the transfer affects an existing contract.
Please contact us if you wish to transfer contractual rights or obligations. This does not prevent you from purchasing an item as a gift or exercising any transferable rights provided by law.
SECTION 20 — INTERPRETATION AND ENFORCEABILITY
These Terms, the relevant product information and policies disclosed before purchase form the agreement relating to your order. They do not exclude statements or commitments that applicable law treats as binding.
If a provision is unlawful or unenforceable, the remaining provisions continue to apply where they can operate independently.
A delay in enforcing a right does not mean that the right has been waived.
Where consumer law requires an unclear term to be interpreted in your favour, that rule applies.
SECTION 21 — GOVERNING LAW AND DISPUTES
These Terms are governed by the laws of England and Wales.
The courts of England and Wales have non-exclusive jurisdiction. You may also bring proceedings in the courts available to you under mandatory consumer law.
If you live elsewhere, choosing the law of England and Wales does not deprive you of mandatory consumer protections that apply in your country of residence.
Please contact us if a problem arises so we can try to resolve it. Contacting us first is not a condition of exercising your legal rights.
SECTION 22 — CHANGES TO THESE TERMS
We may update these Terms to reflect changes to our Services, business practices or legal requirements.
The version in effect when you place an order applies to that order, unless a change is required by law or expressly agreed with you.
For future use of our Services, we will publish revised Terms and update the “Last updated” date. We will provide additional notice where required by law.
SECTION 23 — CONTACT
